1.2 The specific details of each Service (e.g., shipment route, warehouse location, delivery deadline) shall be confirmed in the formal "Service Order" signed by both parties or the order confirmation email sent by us.
2. Customer Obligations
2.1 You shall provide accurate, complete, and legal information when placing an order, including:
•Personal/business identification documents (e.g., passport, business license) required for customs clearance;
•Truthful details of the goods (e.g., product name, quantity, weight, dimensions, value, nature);
•Valid pick-up and delivery addresses, contact person, and phone number (to ensure timely communication and delivery).
2.2 You shall ensure that the goods comply with the laws and regulations of the origin country, transit countries, and destination country/region, including but not limited to:
•Prohibiting shipment of contraband (e.g., flammable, explosive, illegal drugs, counterfeit goods) or restricted items (e.g., weapons, endangered species) without prior approval;
•Providing necessary certificates for special goods (e.g., food hygiene certificates, electronic product certification) where required.
2.3 You shall properly package the goods to withstand normal transportation conditions. If the goods are fragile, perishable, or high-value, you must clearly indicate this and use protective packaging; otherwise, we shall not be liable for damage caused by improper packaging.
2.4 You shall pay the service fees in full and on time in accordance with the payment terms agreed in the Service Order.
3. ONTASK’s Obligations
3.1 We shall provide the Services in accordance with the confirmed Service Order and industry standards, ensuring reasonable care in handling, storing, and transporting the goods.
3.2 We shall keep you informed of the shipment progress in a timely manner, including order confirmation, customs clearance status, warehouse arrival, and delivery updates. You may inquire about the latest status via our website tracking system, phone (+86 400 646 6868 / +8619802059616), or email (3545551305@qq.com).
3.3 We shall protect your personal information and goods-related data in accordance with our Privacy Policy, and shall not disclose such information to third parties except as required by law or for the purpose of providing the Services (e.g., sharing with customs brokers or warehouse operators).
3.4 We shall handle your complaints or inquiries promptly (with a response within 24 hours for working days) and take reasonable measures to resolve issues related to the Services.
4. Service Fees and Payment
4.1 The service fees shall be calculated based on the agreed pricing standard (e.g., weight, volume, service type) in the Service Order. Fees include transportation, basic warehouse storage (within the agreed free storage period), and standard customs clearance; additional fees (e.g., extended storage, emergency handling, special certification) shall be borne by you as specified.
4.2 Payment terms: You shall pay [e.g., 30% advance payment upon order confirmation, 70% balance before shipment] or as otherwise agreed. We may suspend or terminate the Services if you fail to pay the fees on time.
4.3 If you delay payment, we shall have the right to charge a late payment fee at a rate of [e.g., 0.05% of the unpaid amount per day] from the due date until full payment is received.
5. Liability for Goods
5.1 We shall be liable for loss, damage, or delay of the goods caused by our intentional misconduct or gross negligence (e.g., improper handling, incorrect delivery address). The compensation amount shall be limited to [e.g., the actual value of the goods (proven by invoice) or 20 USD per kilogram, whichever is lower], unless you have purchased additional cargo insurance.
5.2 We shall not be liable for any loss or damage caused by:
•Force majeure (e.g., natural disasters, wars, strikes, government bans, customs policy changes);
•Defects of the goods themselves, improper packaging, or misinformation provided by you;
•Losses due to delays in customs clearance caused by incomplete documents or non-compliance of the goods with local laws;
•Indirect losses (e.g., loss of profits, business interruption) unless such losses are caused by our intentional acts.
5.3 If you need to insure high-value goods, you shall notify us in advance and pay the insurance premium; the insurance coverage shall be subject to the terms of the insurance contract signed with the insurance company.
6. Modification, Suspension, and Termination of Services
6.1 Either party may request to modify the Service Order (e.g., change delivery address, adjust shipment time) only with the written consent of the other party. If the modification increases our costs or workload, you shall bear the additional fees.
6.2 We may suspend the Services temporarily if:
•Force majeure or unforeseen circumstances (e.g., port closure, flight cancellation) make it impossible to continue the Services;
•You fail to provide necessary documents or information, or the goods are found to be contraband or restricted items.
6.3 We may terminate the Services and cancel the Service Order if:
•You seriously violate these Terms (e.g., providing false information, failing to pay fees for more than 15 days);
•The goods are confiscated or detained by customs due to non-compliance with laws;
•Continuing the Services would violate applicable laws or pose a risk to our business.
6.4 If we terminate the Services due to your breach, you shall bear the fees already incurred (e.g., transportation costs for the completed part) and compensate us for any losses caused by your breach.
7. Intellectual Property
7.1 All intellectual property rights related to our website (e.g., content, logos, tracking systems) and service materials (e.g., service guides, order forms) belong to ONTASK. You shall not copy, modify, or use such intellectual property without our prior written permission.
7.2 You warrant that the goods or materials provided by you do not infringe the intellectual property rights (e.g., trademarks, patents) of any third party; otherwise, you shall bear full responsibility for any claims or lawsuits arising therefrom and compensate us for any losses incurred.
8. Dispute Resolution
8.1 Any dispute arising from or in connection with these Terms shall first be resolved through friendly negotiation between the parties.
8.2 If negotiation fails, either party may submit the dispute to the [Guangzhou Arbitration Commission] for arbitration in accordance with its current arbitration rules. The arbitration award shall be final and binding on both parties.
8.3 During the dispute resolution process, the parties shall continue to perform the parts of these Terms that are not involved in the dispute, except for matters related to the dispute.
9. Miscellaneous
9.1 These Terms shall be governed by the laws of the People’s Republic of China (excluding conflict of laws rules).
9.2 Any notice between the parties shall be sent via email, registered mail, or fax to the contact information provided by both parties; the notice shall be deemed received [e.g., 24 hours after sending by email, 3 days after sending by registered mail].
9.3 If any provision of these Terms is deemed invalid or unenforceable by a court or arbitration institution, the remaining provisions shall remain valid and enforceable.
9.4 We may update these Terms from time to time. The updated Terms shall be posted on our website, and the "Effective Date" shall be revised accordingly. Your continued use of the Services after the update constitutes acceptance of the new Terms.
