When exporting branded goods to the UAE, the lack of an official Letter of Authorization (LOA) does not absolutely block customs clearance, but the associated risks are extremely high. For formal commercial shipments, smooth passage is nearly impossible without proper authorization. The UAE enforces strict intellectual property rights (IPR) protection. The customs system maintains a comprehensive brand registration database, adopting a zero-tolerance policy for infringing goods.
1.If the brand is registered: Goods without an LOA will be directly deemed as infringing. This typically results in detention, fines, or even destruction of the cargo. The brand owner also reserves the right to pursue legal action.
2.If the brand is unregistered: Goods may still be detained on suspicion of infringement during inspection. Customs will require the submission of authorization documents, leading to costly and time-consuming clearance delays.
The only rare exceptions apply to:
- Small quantities for personal use.
- Neutral products without any brand markings.
- Goods supported by valid proof of legal purchase from the brand owner.
However, these exceptions have no universal standard and rely entirely on on-site customs judgment. They are not reliable for commercial shipments.
Critical Advice for Shippers:For commercial exports of branded goods, it is mandatory to obtain a formal LOA from the brand owner in advance. For certain product categories, additional Hague Apostille or embassy legalization may be required. Ensuring consistency between your invoice, shipping documents, and authorization information is the only way to guarantee smooth customs clearance.
